The Prosecutors Association of Serbia responded with certain reservations to the invitation to participate in the working group for amendments to the set of judicial laws, with the aim of aligning them with the recommendations of the Venice Commission. For this reason, we submitted proposed amendments aimed at implementing the most appropriate solution – namely, the reinstatement of the legislative provisions that had been in effect from May 2023 until the entry into force of the so-called “Mrdić Laws.”
With regard to the provisions requiring new normative solutions in accordance with the recommendations of the Venice Commission, the Association submitted proposals fully in line with those recommendations, and within the working group we advocated for their consistent and complete implementation.
However, based on the progress of the work so far, it is evident that such a commitment was not fully shared among all members of the working group, which leads us to conclude that there is currently no full political will to implement all of the recommendations.
We also consider that the public hearing, scheduled for 06 May 2026, should have been preceded by the finalization of the draft law text, in order to ensure a transparent, inclusive, and substantive debate. For these reasons, the PAS will not participate in the public hearings, though we will continue our work within the working group.
