Freedom of expression and freedom of association of judges and public prosecutors represent fundamental values in a democratic society based on the rule of law. In the contemporary context of increasing pressures on the judiciary, particularly in transitional societies such as Serbia, the question of the limits and protection of these freedoms becomes especially important. Freedom of expression and freedom of association are fundamental human rights, guaranteed by numerous international and national instruments, including the Universal Declaration of Human Rights (Articles 19 and 20) and the European Convention on Human Rights (Articles 10 and 11). However, these rights are particularly sensitive when they concern holders of judicial office, such as judges and public prosecutors. The role of judges and public prosecutors in the public sphere is not limited solely to the application of law in individual cases, but also includes their responsibility to contribute to preserving the integrity of the judiciary.
The analysis aims to provide an overview of European standards in the field of freedom of expression and association of judges and public prosecutors, as well as to compare these standards with the practice and legal framework in Serbia.
