The independence of public prosecutors and protection against undue influence represent key elements in preserving the integrity of the judiciary and the rule of law. In the contemporary context, particularly within the process of European integration and the fulfillment of interim benchmarks under Chapter 23, the issue of institutional mechanisms for protection against pressure gains additional importance. Protection against undue influence does not relate solely to individual holders of prosecutorial office, but primarily to the preservation of institutional values – independence, impartiality, and the authority of the prosecution service. In this regard, international and European standards emphasize the obligation of the state to ensure conditions in which prosecutors can perform their duties without intimidation, pressure, or improper interference.

The analysis aims to present the normative framework and the development of mechanisms for protection against undue influence, the role and practice of the Commissioner for Independence, as well as to assess their effectiveness through reports, practice, and the perception of both domestic and international public.
