With the aim of gaining deeper insight into the state of freedom of expression within the judiciary, the Prosecutors Association of Serbia conducted a survey based on an electronic questionnaire intended for judges and public prosecutors. The questionnaire was distributed in digital form, respecting the principles of voluntariness and anonymity, in order to ensure open and honest participation. A total of 99 respondents fully completed the questionnaire, providing a relevant basis for conducting both qualitative and quantitative analysis. The research covers issues related to knowledge of the legal framework, institutional support, the presence of pressure and consequences following public statements, as well as respondents’ recommendations for improving conditions for exercising freedom of expression within the judiciary.
The aim of the analysis is to compare European standards with existing domestic practices and to provide insight into the challenges and opportunities for improving the position of judicial office holders in the context of freedom of expression. The issue of freedom of expression for judges and prosecutors is not merely a matter of individual rights, but is directly linked to the preservation of the rule of law, institutional transparency, and democratic processes.
